Introduction

Project Unite, Inc. (“Project Unite”, “our”, “us” or “we”) has created this privacy statement (the “Policy”) in order to demonstrate our firm commitment to privacy. The following discloses our personal information gathering, usage, processing, protection, and dissemination practices for websites and mobile applications that we own and control, including www.dignity.us and the Dignity Daily mobile application (collectively, “Digital Properties”). This Policy applies to personal information (or such similar terms) collected through:

  • the Digital Properties

  • other electronic means, such as emails and other communications between us, including phone calls;

  • other means through which you may disclose personal information to us, such as through paper forms and interactions at Project Unite events; and

  • other data collection points where we refer to this Policy.

This Policy does not apply to:

  • any third party websites, including any application or content that may link to or be accessible from the Digital Properties, or any social media platforms where we may post messages, images, and other content, or invite feedback.

  • any processing of personal information by us or on our behalf of that is covered by a more specific privacy notice.

Please read this Policy carefully to understand our policies and practices regarding your personal information and how we will treat it. By using the Digital Properties and/or providing personal information to us, you acknowledge the details of processing contained in this Policy then in effect and we shall process your personal information in accordance with the provisions of our Policy then in effect. If you do not agree with the terms of this Policy, you should not use the Digital Properties or otherwise provide personal information to us.

If you are located in the United Kingdom (“UK”), the European Union (“EU”) or the European Economic Area (“EEA”) or if our processing of our personal information is otherwise subject to applicable laws and regulations relating to privacy, protection or processing of personal information in the EEA, EU and UK, including the General Data Protection Regulation (Regulation (EU) 2016/679) (“EU GDPR”) and the UK’s equivalent to the EU GDPR, (the “EEAUK Privacy Laws”), please also refer to our EEA-UK Privacy Supplement below.

What and How Personal Information is Collected

We collect different types of personal information from and about users of the Digital Properties. This includes both information by which you may be personally identified (such as name, phone number, email address, home address, and billing address), and information that is about you but individually does not directly identify you. We collect this information directly from you when you provide it to us and automatically when you navigate through the Digital Properties.

Personal Information Collected by Automated Technologies

Subject to your consent for any unnecessary cookies, the Digital Properties use the cookies listed in the “Cookies” section below.

Personal Information You Provide

Our Digital Properties use forms where you may sign up for communications from Project Unite, make a donation to Project Unite, or otherwise engage with Project Unite (such as signing up for Project Unite events or volunteering for Project Unite). We collect contact information by which you may be personally identified (such as name, phone number, email address, home address, and billing address), and financial information (like account or credit card numbers), as well as details of transactions you carry out through the Digital Properties via our third-party payment processors. Contact information from registration and other forms is used to send information about our organization. Your contact information is also used to get in touch with you when necessary. We also collect records and copies of your correspondence (including email addresses) if you contact us. You may opt out of receiving future mailings as noted below or as otherwise indicated on communications you may receive from Project Unite.

You grant Project Unite permission to process and store all information you submit to Project Unite in accordance with this Policy and grant Project Unite permission to verify the accuracy of all such information.

How to View or Change Your Personal Information

If you wish to modify the frequency of future communications from Project Unite, please contact us using the contact information at the bottom of this Policy.

You can also view and request changes to all the information you have given us, including any mailing lists you may be on, by contacting us using the contact information at the bottom of this Policy.

Depending on the data protection laws that apply to our processing of your personal information, you may have additional rights with respect to our processing of your personal information, including, to the extent applicable, the rights set out in the EEA-UK Privacy Supplement below.

How We Use Your Personal Information

We may use personal information and information that we collect, or that you provide to us, for the following purposes:

To improve the experience and services offered.  Our legitimate interest in operating our business and the Digital Properties (to enhance user experiences and improve services).

Note that we may process your personal information on more than one legal basis depending on the specific purpose for which we are using your personal information. We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and explain the legal basis which allows us to do so.

Disclosure of information

To fulfil the purposes described in this Policy, we provide personal information to: (i) specific thirdparty service providers, such as our credit card processor, the host of the Digital Properties, or the providers of automatic data collection technologies embedded into the Digital Properties, in order to provide you certain services available through the Digital Properties; (ii) other third parties that we may partner with (including for purposes of soliciting and processing donations or for email distribution); and (iii) entities that are owned by or affiliated with Project Unite. We may disclose your personal information to comply with any court order, law, or legal process, including to respond to any government or regulatory request. We also may disclose your personal information to protect the safety and security of users of the Digital Properties, and that of Project Unite’s employees, affiliates, agents, licensors, and service providers. We may disclose your personal information to ensure your compliance with our policies, and to enforce our Terms of Service and other applicable agreements. When we disclose your personal information, we will only do so to the extent such disclosure complies with applicable data protection laws.

General Security Matters

We use reasonable measures to secure and to protect against the accidental loss, unauthorized access, misuse, disclosure and alteration of the personal information under our control. Unfortunately, the transmission of information via the internet is not completely secure and we cannot guarantee the security of your personal information transmitted to the Digital Properties. We are not responsible for third-party circumvention to any privacy settings or security systems and any transmission of personal information is at your own risk.


Specific Rights

Children Under the Age of 18

The Digital Properties are not intended for children under 18 years of age. Project Unite does not knowingly collect personal information from children under 18 years old. If you are under 18 years old, do not use or provide any information on the Digital Properties. Do Not Track Standards

We do not recognize or respond to browser-initiated Do Not Track signals, as the Internet industry is currently still working on Do Not Track standards, implementations and solutions. Links to Third Party Sites

The Digital Properties may contain links to certain third party websites or applications. We do not own, control, or operate such linked sites and we are not responsible for the privacy policies or practices of such linked sites. Privacy policies and practices for such linked sites may differ from this Policy and our practice. Your access and use of such linked sites is entirely and solely at your own risk. We urge you to read the privacy policies of such linked sites before disclosing your personal information on such sites. Similarly, we cannot control how your data is collected, stored, used, or shared by third party sites. Please be sure to review the privacy policies and privacy settings of such third party sites (including social networking sites) to make sure you understand the information they are sharing. If you do not want a third party site to share information about you, you must contact that site and determine whether it gives you the opportunity to opt-out of sharing such information. Project Unite is not responsible for how these third parties may use information collected from or about you.

The Controller

To the extent that EEA-UK Privacy Laws apply to our collection and processing of your personal information, Project Unite will be the “controller”. In simple terms, this means we: (i) “control” the personal information that we collect from you or other sources; and (ii) make certain decisions on how to use and protect such personal information.

Categories of Personal Information We May Collect

We collect and process limited categories of personal information as further set forth in the “The Information We May Collect” section in the Policy above. We do not collect any special categories of personal information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses.

How We Obtain Your Personal Information

In connection with forming and operating the Digital Properties, we collect and process your personal information from you and other third parties and/or publicly available sources listed in the “What and How Information is Collected” section in the Policy above.

How We Use your Personal Information

There is a need to process personal information for the purposes and on the legal bases set out in the “How We Use Your Information” section in the Policy above. No automated decision-making, including profiling, is used when processing your personal information.

Disclosure and Transfer of Personal Information

We may share your personal information with certain service providers as necessary to fulfill the purposes set out in “Disclosure of Information” section of the Policy. We reserve the right to disclose your personal information as required by law, or when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, request from a regulator, national security, for the purposes of public importance or any other legal or investigatory process involving us. Should we, or any of our affiliated entities, be the subject of a takeover, divestment or acquisition we may disclose your personal information to the new owner of the relevant business and their advisors on the basis of our legitimate interest.

Project Unite is based in the United States which for the purposes of EEA-UK Privacy Laws is a Non-Equivalent Country (as defined below). If you are a user located outside the United States, by using the Digital Properties and providing your personal information, you acknowledge and accept that your personal information will be transferred to and processed in the United States. For the purposes of this EEA-UK Privacy Supplement, “Non-Equivalent Country” means a country or territory other than (i) a member state of the EEA; (ii) the UK; or (iii) a country or territory which has at the relevant time been decided by the European Commission, the Government of the UK or the UK Information Commissioner’s Office (as applicable) in accordance with the applicable EEA-UK Privacy Laws to ensure an adequate level of protection for personal information.

Security and Retention of Personal Information

We take measures designed to protect the security of your personal information as described in the “General Security Matters” section in the Policy above.

We will keep your personal information only for as long as is reasonably necessary for the purposes set out in the Policy unless a longer retention period is required by law or regulatory obligations which apply to us, or where necessary to defend or pursue legal claims. We will not keep more personal information than we need for those purposes.

Your Rights

To the extent the EEA-UK Privacy Laws apply to our processing of your personal information, you may have the following rights:

  • Access: You have the right to ask for a copy of the personal information that we hold about you free of charge, however we may charge a “reasonable fee,” if we think that your request is excessive, to help us cover the costs of locating the information you have requested.

  • Correction: You have the right to notify us of changes to your personal information if it is inaccurate or it needs to be updated.

  • Deletion: If you think that we should not be holding or processing your personal information anymore, you may request that we delete it. Please note that this may not always be possible due to legal and regulatory obligations.

  • Restrictions on use: You have the right to request that we stop processing your personal information (other than storing it), if: (i) you contest the accuracy of it (until the accuracy is verified); (ii) you believe the processing is against the law; (iii) you believe that we no longer need your personal information for the purposes for which it was collected, but you still need your personal information to establish or defend a legal claim; or (iv) you object to the processing, and we are verifying whether our legitimate grounds to process your personal information override your own rights.

  • Object: You have the right to object to processing, including: (i) for direct marketing; (ii) for research or statistical purposes; or (iii) where processing is based on legitimate interests, unless we reasonably demonstrate compelling legitimate grounds for the processing.

  • Portability: If you wish to transfer your personal information to another organisation (and certain conditions are satisfied), you may ask us to do so, and we will send it directly if we have the technical means.

  • Withdrawal of consent: If you previously gave us your consent (by a clear affirmative action) to allow us to process your personal information for a particular purpose, but you no longer wish to consent to us doing so, you can contact us to let us know that you withdraw that consent. This will not affect the lawfulness of processing based on consent before its withdrawal.

These rights are not absolute and in certain circumstances their exercise may not be possible including when personal information must be maintained to comply with applicable laws.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Should you wish to lodge a complaint with regards to how your personal information has been processed by us under:

  • the EU GDPR, please contact your local supervisory authority in particular in the EU Member State of your habitual residence, place of work, or place of the infringement, concern or complaint.
